The 1931 constitution comes from the second republic ,this was the second period of Spanish history in which both Head of State and Head of government were democratically elected. The Second Republic began on 14 April 1931 after the departure from Spain of King Alfonso XIII. The 1931 constitution  was a constitution very advanced for his time. It had a marked democratic and progressive character, in his first page there was written that Spain was a workers republic of all the classes organized in a liberty and Justice regime. The constitution established an anticlerical government, and granted civil liberties, with the exception of the rights of Catholics.

The 1931 constitution gruped the following characteristics:
  • Popular sovereignty : people had the sovereigntyand the state was declared ‘’democratic republic of workers’’.
  • Universal suffrage:There was a debate in the courts in which it was given the right to vote to spanish women, so Spain became in one of the first european nations to give women this right.
  • The división of powers between the state: Cortes (legislative power), government (executive power) and tribunal and courts (judicial power).
  • Regions in Spain were allowed for the first time to establish their own home rule.                        Establishment of a secular state.
  • And finally  it includes a long list of rights and liberties , ones of the most important were: 

Freedom of speech, meeting and association; civil rights such as divorce and the insurance of the equality of legitimate and ilegitimated children and  the right to a good qualified education.
